General Terms and Conditions
1. These General Terms and Conditions (hereinafter also referred to as the "Rules") govern the relationship between the parties to the Purchase Agreement, the Seller, Bencsik Beata, registered address: 2371 Hinterbrühl, Eichbergstraße 10/2/15, Reg. No. 38614934, registered in the Bezirkshauptmannschaft Mödling, Austria (also referred to as Shine and Glow or the Seller), and the Buyer.
2. The Buyer is a person who has entered into a Purchase Agreement with the Seller and purchased goods from the Seller through the online store at www.shineandglow.store, and who has the right to assert liability for defects in the goods (hereinafter referred to as the "Buyer").
3. The use of the distance selling procedure described in these General Terms and Conditions is exclusively for consumers within the meaning of the German Civil Code (ABGB) and the Consumer Protection Act (KSchG), i.e., a person who does not pursue a commercial activity or exercise a self-employed professional activity, but rather enters into a relationship with the merchant or otherwise cooperates with him. Shine and Glow reserves the right not to process orders from persons other than "consumers."
4. These General Terms and Conditions and the purchase contract were concluded in English.
5. By placing an order, the buyer confirms that they have familiarized themselves with these rules.
II. Security and Information Security
1. Upon purchase, the buyer provides the following information:
- First name and surname;
- Email address;
- Telephone number.
This data is necessary for the buyer's identification and further communication for the purpose of delivering the goods.
2. The terms of personal data processing and the specification of certain personal data to which the buyer agrees are contained in the "Personal Data Protection" document.
3. As part of the warranty claim procedure, buyers must provide the following information: first name, surname, address, telephone number, and email address. All personal data collected in this way will be processed solely for the purposes necessary to process the warranty claim. The buyer has the right to make changes to their personal data, including the right to request an explanation and/or the removal of incorrectly entered data, as well as other rights granted by law.
III. Conclusion of a Purchase Agreement
1. The contract is concluded electronically (by email), i.e., based on the Buyer's electronic order (by submitting the order, the Buyer sends an offer to conclude a Purchase Agreement), which is confirmed by the Seller (acceptance of the offer).
2. The Purchase Agreement is concluded when the Buyer submits the order and the Seller accepts the order. The Seller will promptly confirm this order to the Buyer with an informational letter sent to the email address specified in the order. In the informational letter, the Buyer will find a link to the current version of the Terms and Conditions.
3. By concluding the Purchase Agreement, the Seller undertakes to hand over the purchased goods to the Buyer, and the Buyer undertakes to accept the goods and pay the Seller the purchase price. The Seller retains ownership of the goods until full payment is received. The Seller must send the goods to the specified delivery service to deliver the goods to the final Buyer. The Seller will provide the Purchase Item to the Buyer in the agreed quantity, quality, and design. If no agreement has been made regarding how the goods should be packaged, the Seller will package the goods in the order required to keep the items safe and secure. The Seller will also package the goods for transport.
IV. Prices and Payment Terms
1. The buyer receives the goods at the price valid at the time of the order. The buyer has the opportunity to familiarize themselves with the total price, including VAT and all other fees, before placing the order.
2. The seller accepts the payment terms available here.
3. The goods remain the property of the seller until full payment has been received. The risk of damage to the goods passes to the buyer upon delivery of the goods. If the goods are shipped against advance payment, the payment terms are subject to change.
V. Delivery Conditions
1. Delivery conditions for goods within the agreed deadlines are:
- Verification of the order;
- Availability of the ordered goods in the quantity specified in the electronic order;
- Delivery and payment according to the information on the Shine and Glow.
2. In most cases, the delivery time for goods offered by the Seller is 10 business days from the date of order confirmation, with a maximum delivery time of 12 business days. The order is usually handed over to the transport company within 1 business day after order confirmation. The delivery time may be extended, also in case of insufficient information for shipping the order.
3. Delivery options in Austria:
- Delivery of the goods to the address of the imposed payment. The goods are shipped by the delivery service. The courier delivers packages on business days, usually within 10 business of dispatch.
- Delivery of the goods to the address or branch of the delivery service without imposed payment. Delivery of the goods is subject to the same conditions as delivery with the imposed payment, except that the Buyer agrees on an individual payment method with the Seller. The Buyer is obliged to collect the goods from a third party (the Seller's transport partner).
4. The Seller's obligation to deliver the ordered goods is fulfilled by transporting the goods and handling them over to the courier (delivery) service for further delivery to the destination. Liability for accidental loss, damage, or destruction of the goods passes to the Buyer at the time of acceptance of the goods or at the time when the Buyer was obliged to accept the goods but did not do so in breach of contract. In the event of a delay in delivery of the order, please contact the Seller at info@shineandglow.store.
5. The Seller may charge for delivery of the goods. Detailed information on the costs and terms of delivery can be found in the Delivery tab. In addition, information on the price, date, and delivery costs will be provided during the order process and confirmed by Shine and Glow in an email to the Buyer.
The buyer will receive a tax receipt (invoice) along with the goods. All prices quoted include VAT.
VI. Withdrawal from the Contract
1. Termination of the Contract by the Buyer who is a Consumer:
In accordance with the provisions of Article 7 of Law 102/2014, the Buyer has the right to withdraw from the contract without giving any reason within 14 calendar days of receipt of the goods or from the date of the service contract. If the buyer wishes to exercise their right of withdrawal, they must send the goods via the Austrian Post parcel service to the following address: Beata Bencsik, 2371 Hinterbrühl, Eichbergstraße 10/2/15, Österreich, along with all testers and documentation, such as the original invoice, instructions, and other documentation for items delivered with the goods, but no later than 14 days from the date of the declaration of withdrawal from the contract.
The cost of returning the goods is borne by the consumer. In the event of withdrawal from the contract within 14 days of the delivery date, the consumer is also entitled to a refund of the delivery costs in the amount of the cheapest delivery option.
The above amounts will be refunded to the consumer/buyer promptly, but no later than within 14 days of receipt of the refund. Unless otherwise agreed, the money will be refunded in the same way the buyer made the payment.
2. The consumer may not withdraw from the contract in the following cases:
Sale of goods or provision of services whose price depends on price movements in the financial market over which the seller has no control and which may occur after the expiration of the contract;
Sale of goods manufactured according to specific consumer requirements, custom-made products, or goods specifically intended for a consumer;
Sale of goods that perish quickly;
Sale of goods in protective packaging that cannot be returned for health or hygiene reasons and whose protective packaging was damaged after delivery;
Sale of goods that can be inseparably mixed with other goods after delivery.
VII. Liability for Product Defects and Warranty
1. The warranty conditions for goods are governed by these provisions and the existing laws of the Republic of Austria.
2. Shine and Glow is liable for defects that occur after delivery of the goods by the buyer during the warranty period. The warranty period for all goods offered in the Ksisters online store is 24 months, unless a shorter period is stated on the goods. The warranty period begins from the time the buyer receives the goods.
VIII. Complaints
1. If a defect is discovered upon delivery, Shine and Glow will refund the amount to the buyer in the form of a voucher (a reasonable discount for the next order).
The buyer may also request that the defect be remedied as compensation. If it is impossible or unreasonable for Shine and Glow to remedy the defect, the buyer has the right to demand a reduction in the purchase price and – in the case of a significant defect – to withdraw from the purchase contract.
The buyer must inform the seller of the right chosen when submitting a complaint.
2. Goods are deemed to be defective in particular if they do not have the usual or reasonable quality, do not correspond to their intended purpose, do not comply with legal requirements, or were not delivered in the agreed quantity. Increased sensitivity or allergic reaction to the delivered goods is not grounds for recognizing a defect in the goods. Likewise, defects in gifts or free items not included in an order are not considered a defect in the goods. Product photos in our online shop are for illustrative purposes only and do not constitute a binding description of product properties (e.g., packaging may vary due to manufacturer changes).
3. Complaints should be sent to info@shineandglow.store along with the complaint form available here. When completing the form, please do not forget to describe the defect and (if possible) attach photos of the defective product. Goods with reported defects must be sent, after confirmation, via the parcel service “Post" to the following address: Beata Bencsik, 2371 Hinterbrühl, Eichbergstraße 10/2/15, Österreich.
4. Shine and Glow will inform the buyer about the assessment of the warranty claim, in particular the receipt of the complaint and its positive or negative assessment, by email or SMS. Shine and Glow may also contact the customer by phone.
5. The complaint will be examined promptly. The examination of the complaint, including the remedy of the defect, generally takes less than 30 days. Otherwise, the buyer has the right to withdraw from the contract. The buyer is obliged to assist Shine and Glow in meeting the above-mentioned deadline.
6. In the event of a positive complaint, Shine and Glow will bear the cost of returning the goods.
IX Loyalty Program - Shine and Glow Club
1. By purchasing products in the Shine and Glow online store, you become a member of the Shine and Glow Club loyalty program (hereinafter referred to as the Loyalty Program or Shine and Glow Club).
2. Under the Loyalty Program, members receive cashback to their loyalty account for purchases of cosmetics in the Shine and Glow online store. The amount of accumulated loyalty cashback corresponds to the purchase price in euros.
3. The more products a Loyalty Program member purchases, the more benefits they receive. The loyalty levels and benefits received by members are listed below:

4. Accumulated cashback cannot be sold or donated. Cashback cannot be exchanged for cash. Accumulated cashback can only be used to pay for up to 50% of the value of the product.
5. Cashback is payable for each purchase within one year. Buyers can check their available cashback on the website; they must be authorized to do so. They can also check this information in the shopping cart when placing an order.
6. Shine and Glow is not responsible for any unlawful use of cashback by third parties, unless the loyalty program member has notified the company in a timely manner of the loss of access to their account.
7. Shine and Glow reserves the right to terminate or suspend the loyalty program at any time. Furthermore, Shine and Glow reserves the right to change the cashback accrual system.
8. In the event of termination or suspension of the loyalty program, Shine and Glow undertakes to notify loyalty program members on the Shine and Glow website. In this case, any unused cashback will be canceled.
9. Membership in the Shine and Glow Club and related services are free of charge.
10. A loyalty program member may voluntarily withdraw from the Shine and Glow Club at any time. In this case, the customer sends a cancellation request to the following email address: info@shineandglow.store.
X. Referral Program
1. Eligibility.
The Referral Program is available only to Shine and Glow customers who are at least eighteen (18) years of age at the time of participation.
Your participation in the Referral Program and use of your referral link or promo code constitutes your full and unconditional acceptance of the terms and conditions set forth in this Agreement, and the decisions and interpretations of Shine and Glow, which are final and binding in all matters relating to this program.
A new buyer within the framework of the Referral Program (hereinafter referred to as "Referrals") is a combination of a unique phone number and email address (those that have not been used when placing orders on the Shine and Glow website in any domain zone).
If you are a new buyer, you will have the opportunity to receive a discount on your first order; the amount of the discount will be determined at Shine and Glow’s sole discretion.
To do this, you must use a referral link or referral promo code provided to you by a friend.
For the promo code to be applied, you must be registered or logged in on the website, and there must not be any successful purchases in your account.
2. General Information about the Referral Program.
Subject to meeting the eligibility requirements, you can participate in the Referral Program after purchasing products offered on the website.
48 hours after receiving your first order, you will be automatically registered in the Referral Program and, as a member, will be able to receive €5 cashback on your Ksisters Club account (hereinafter "Cashback").
If you wish to decline participation in the Referral Program, please contact us by email: info@shineandglow.store.
As stated above, a special link or promo code (hereinafter referred to as "Referral Link") will be generated in your account 48 hours after your first order is received and will be available in your personal account /my-shineandglow-club. You can share your referral link with potential new customers.
For orders placed by referrals who access the Shine and Glow website via your referral link or use your promo code on their first order, you will receive cashback, provided that the referral's first order is for €30 or more.
You can use the cashback in the same way as the points in the loyalty program.
3. Receiving cashback
Cashback will be credited to your loyalty program account.
The cashback will be credited to your account within 48 hours after the referred customer receives their first order, provided they used your referral link or promo code, and all other requirements outlined in these rules have been met.
XI. Alternative Dispute Resolution
1. The buyer has the right to request compensation from the seller (by email to info@shineandglow.store) if they are dissatisfied with the seller's handling of their complaint or if they believe the seller has violated their rights. If the seller refuses this request or does not respond within 30 days of receipt, the buyer, as a consumer, may exercise their right to alternative dispute resolution and file a complaint through the online dispute resolution platform available.
2. Disputes between the customer and Shine and Glow that cannot be resolved amicably in accordance with the above provisions will be settled by the court having jurisdiction over the customer's place of residence.
XII. Final Provisions
1. The buyer acknowledges and agrees that the rights and obligations between the seller and the buyer are governed by these General Terms and Conditions and the applicable provisions of Austrian consumer protection law.
2. Any matters not expressly addressed in these General Terms and Conditions shall be governed by the law in effect at the time the individual purchase agreement is concluded.
3. By submitting the order, the buyer confirms that they have read and fully accepted these terms and conditions.
4. Should one or more provisions of these terms and conditions become invalid in whole or in part, the validity of the remaining provisions shall not be affected, and they shall remain in full force and effect.
These General Terms and Conditions come into effect on 01.10. 2025.
